1. Introduction and Agreement

These Terms and Conditions (“Terms”) govern the provision of dental care services by Carehome Dental /Carehomedental.co.uk (referred to as “we,” “us,” or “our”) to you, the patient, or the person legally responsible for arranging the patient’s care (“you” or “the patient”). By engaging our services, you agree to be bound by these Terms.

 

2. Scope of Service

Carehomedental.co.uk provides NHS-registered domiciliary dental services within Scotland. Our services are delivered to patients who are housebound, elderly, or have mobility issues in their residence (including private homes and care homes).

2.1. Services Provided: Services include, but are not limited to, free NHS dental exams, oral cancer screening, denture fitting and adjustments, emergency visits, and other preventive and restorative treatments as assessed by our clinician.

2.2. Limitations: The scope of treatment is determined by the suitability of the domiciliary environment and the portability of our equipment. Procedures requiring a fully equipped dental surgery may necessitate referral or transport, which is not included in our standard domiciliary service.


3. Patient Eligibility and Responsibility

3.1. Eligibility: Our service is intended for individuals who are medically or physically unable to attend a conventional dental practice.

3.2. Patient Information: You must provide accurate and complete medical and contact information upon referral and assessment. Any changes to the patient’s health or contact details must be promptly communicated to us.

3.3. Access and Safety: You are responsible for ensuring the care location is accessible, safe, and allows a reasonable space for our mobile dental team to set up and provide treatment.


4. Consent and Capacity

4.1. Valid Consent: Treatment will only be provided once valid consent has been obtained from the patient or their legal representative.

4.2. Adults with Incapacity (AWI): Where a patient lacks capacity, we follow the procedures outlined by the Adults with Incapacity (Scotland) Act 2000. Our team will manage all AWI-compliant consent procedures and documentation with the responsible welfare guardian or carer.

4.3. Refusal of Treatment: The patient, or their legally authorised representative, has the right to refuse or withdraw consent for any proposed treatment at any time.


5. Fees and Payment

5.1. NHS Funding: All dental exams and home visits are funded by the NHS in Scotland and are free of charge.

5.2. Treatment Charges: Subsequent treatment (e.g., restorative work or dentures) may carry standard NHS charges, unless the patient is exempt under current NHS Scotland regulations.

5.3. Private Charges: Any non-NHS services will be discussed and agreed upon with the responsible party prior to treatment commencement.

5.4. Payment: Payment for NHS charges or private treatment is due upon completion of the treatment or as otherwise agreed in writing.


6. Appointment and Cancellation

6.1. Scheduling: Appointments are scheduled based on patient need, geographical location, and availability of our mobile team.

6.2. Cancellations: If an appointment needs to be cancelled or rescheduled, we request that you notify us as far in advance as possible. Failure to notify us of a cancellation or missed appointment may result in an administrative fee.


7. Data Protection and Privacy

We process all personal and medical data in accordance with our Privacy Policy and comply with GDPR, DPA, and PECR. Details on how your data is collected, used, shared, and your rights are available in our full Privacy Policy.


8. Liability

8.1. Clinical Responsibility: We maintain professional indemnity insurance to cover claims arising from clinical negligence.

8.2. Exclusions: We shall not be liable for any damage or loss caused by a failure to disclose accurate medical information, or by non-compliance with post-treatment instructions.


 

9. Governing Law

These Terms are governed by the laws of Scotland, and any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Scottish courts.
